<p>A credit repair company that falsely claimed it would help boost consumers’ credit ratings will settle Federal Trade Commission charges filed last year as part of “Operation Clean Sweep,” a federal-state crackdown on credit repair scams.</p>
<p>The FTC charged the Chicago-based defendants with falsely promising to remove negative information from consumers’ credit reports, even if it was accurate and current, in violation of the FTC Act and the Credit Repair Organizations Act. They also allegedly violated federal law by requiring payment before any service was provided to consumers. According to the FTC’s complaint, the defendants’ advertising stated, “We would never charge a large fee up front, or make you wait a long period of time to refund your money if we do not get results. You WILL see results in 60 days, or your money will be refunded in full . . . .” They charged $495 per person and $665 for a couple and required $219 or $269, respectively, in advance.</p>
<p>The settlement order bars the defendants from further violations and from misrepresenting:</p>
<ul>
<li>They can improve consumers’ credit reports by permanently removing negative information, even when it’s accurate and current;</li>
<li>They can otherwise improve a consumer’s credit report or ability to obtain credit;</li>
<li>The full cost of their services and any restrictions on consumers’ use of those services;</li>
<li>Their refund or cancellation policy; or</li>
<li>The benefits of using their goods or services.</li>
</ul>
<p>The order imposes a $226,793.90 judgment that will be suspended once they pay $20,000. The full judgment will become due immediately if the defendants are found to have misrepresented their financial condition. The order prohibits the defendants from collecting any payments from consumers who purchased their services before October 23, 2008, when the court halted their business practices and froze their assets. The order further bars them from<br />
disclosing or benefitting from customer information, and failing to properly dispose of customer<br />
information.</p>
<p>The defendants are Advantage Credit Repair LLC and Mark D. Solomon. The Commission vote to authorize staff to file the stipulated final order was 4-0. The proposed order was filed in the U.S. District Court for the Northern District of Illinois, Eastern Division.</p>
<p>The Commission appreciates the assistance of the Better Business Bureau of Chicago &amp; Northern Illinois in this case.</p>
<p>The FTC offers consumer information, “Credit Repair: How to Help Yourself,” at<a href="http://ftc.gov/bcp/edu/pubs/consumer/credit/cre13.shtm">http://ftc.gov/bcp/edu/pubs/consumer/credit/cre13.shtm</a>, and advises that only time, a conscious effort, and a personal debt repayment plan can improve a credit report. The first step is to learn what information is in the credit report. If there are errors or mistakes, federal law provides the right to have them corrected – free of charge. Federal law requires that the nationwide consumer reporting companies – Equifax, Experian, and TransUnion – provide consumers with a free copy of their credit report once every 12 months, if requested. To order your free report, consumers can visit <a href="http://www.annualcreditreport.com/">annualcreditreport.com</a>, call 1-877-322-8228, or complete and mail the Annual Credit Report Request Form.</p>

<p>If cleaning up your credit reports and increasing your credit scores is a goal for you in 2010, then this may be the most important message you will have seen this month!</p>
<p>Since January seems like a good time to get started on New Years Resolutions and you want to <a href="http://www.crushingthecreditbureaus.com" target="_blank">repair credit report, </a>then follow along as I guide you through the process of getting your credit reports (notice I didn&#8217;t say credit scores, more on that later)</p>
<p>To take full advantage of all the content available to you now, and increase your score as fast as possible, you&#8217;re going to need to get the bureaus &#8220;standardized&#8221; reports. You can only get them through the mail.</p>
<p>UPDATE: Alright, I&#8217;ve changed my tune a little on this one. If you are in a BIG hurry, you can get them online at <a href="http://www.freeannualcreditreport.com./" target="_blank">www.freeannualcreditreport.com.</a> Print the reports and save the link information. This usually takes about 30-45 minutes. Transunion gives you their &#8220;standardized&#8221; report online. Equifax and Experian give you reports that are very similar and easy to work with.</p>

<p>If you don&#8217;t qualify for a free report, then call:</p>

<p>** Have a credit or debit card and about $28 available.</p>

<p>If you have an old copy of your credit report, you can dispute an address, or wrong name, and mail it to each bureau. Request a free updated report in your dispute, and mail it first class.</p>
<p>Always remember to include in your dispute your:</p>
<p>Full name<br />
Current address<br />
SSN<br />
Date of birth<br />
Previous address</p>
<p>&#8230; As well as a copy of a government issued photo ID and your SSN card (or a copy of some type of utility bill in your name that matches your address.)</p>
<p>OR</p>
<p>If you&#8217;ve been denied credit, insurance, or other benefits within the last 60 days, mail a letter to each bureau requesting a free report with a copy of the denial notice.</p>
<p>OR</p>
<p>Some prefer to use one of the bureaus online 3-in-one services so they can monitor their reports. Do what works for you! In any case, get as many reports as possible so you can compare them and find different angles of factual dispute.</p>
<p>OR</p>
<p>Instantly get a free Experian report online by initiating a 90 day fraud alert. This alert will transmit to Equifax and Transunion, so you might not want to do this if you are seeking any credit within that period of time. If you do apply for credit within 12 months, make sure the fraud alert is removed PRIOR to applying. You can get your free instant report here:</p>

Even when the economic crisis is over, many individuals will need to know how to repair credit following financial hardship.</p>

			<content:encoded><![CDATA[<p></p><p>   Okay, now that the holiday season is behind us&#8230;it&#8217;s time to get started on cleaning up bad credit that you may have accumulated during 2008. Let&#8217;s face it, this was one of the worst years on record for personal financial chaos.</p>
<p>   When I speak at real estate investing seminars across the country, one of the common questions that comes up is whether or not to hire a lawyer ( not some legal sounding dispute letter writing company) to challenge bad credit items. Here is my take on the subject:</p>
<p>   When repairing your credit score there are legal credit repair services and options to make this happen. There are rules that the credit card companies and banks have to follow when placing items on your credit report. There are also rules about having negative marks removed as well. There are companies that can help you have these negative marks removed from your report and get back your credit score.</p>
<p>These companies and organizations are well versed in the area of credit repair and credit scores. Their only job is to help people remove negative marks and fix the errors that credit bureaus regularly make on consumer credit reports. Unfortunately, these negative marks lower your credit scores greatly and can be extremely difficult to remove and receive assistance from the credit bureaus.</p>
<p>Common mistakes that are found on many credit reports include:</p>
<ul>
<li>Incorrect names or names that you have never gone by</li>
</ul>
<ul>
<li>Misspelling your name or parts of your name</li>
</ul>
<ul>
<li>Wrong addresses or address or states that you have never lived in</li>
</ul>
<ul>
<li>Wrong job and employment information</li>
</ul>
<ul>
<li>Mixing family information, accounts added because of the same last name, but that are not yours.</li>
</ul>

<li>Incorrect account numbers</li>

<li>Duplicate accounts, the same account showing up multiple times on the same report</li>

<li>Missing accounts that are in good standing that are not showing</li>
</ul>
<ul>
<li>Incorrect balances of accounts</li>
</ul>
<ul>
<li>Accounts that should have fallen off the credit report already</li>
</ul>
<ul>
<li>Collection accounts that have been paid or are not yours</li>
</ul>
<p>   These are just a few of the errors that are made all the time on consumer credit reports. Almost anything that the credit bureaus and credit card companies can make a mistake with, they will. You have to check your report at least once a year to make sure that it is right and error free. All these different mistakes can add up and drastically lower your credit score.</p>
<p>   Even when some errors could be in your favor, they should still be fixed and shown to report accurate information. It is all a part of your credit report and all information should only pertain to you and reflect accurately your credit history. That is when a professional legal credit repair service is very useful.</p>
<p>   They will help you write and create the letters to send to have these errors fixed. For example, when you appeal an item on your credit report you can request that you be sent proof that the account is yours. If the credit card company or bank can not do this, then the account must be removed immediately. Each and every one of the credit bureaus is is a publicy traded company. They make most of their revenue by selling information (i.e. credit reports) to lending institutions, insurance companies, utility companies, credit card issuing banks, and employers.</strong></p>
<p class="subtitle"><strong>   They DO NOT make money by researching your credit disputes&#8230;in fact, it costs them time, money, and resources to investigate them. Is it any wonder then who the credit bureaus ultimately serve?</strong></p>
<p class="title"> </p>
<p class="title"><strong>Credit Bureau Secret #1</strong></p>
<p><strong>Credit Bureau Reports &#8211; Your 92 Credit Scores</strong></p>
<p class="bodycopy">   Credit reports and scores are created &#8220;on the fly&#8221; whenever they are requested by you, a creditor, or a lender<strong>. </strong>In fact, you can have up to 92  different credit scores&#8230;23 different credit scores for each Bureau: Transunion, Experian, Equifax and don&#8217;t forget the little known &#8220;other&#8221; credit bureau named Innovis.</p>

<p class="bodycopy">One reason is that when you pull a report from an online service 18 elements of identification have to match exactly. For example, all of the letters of your last name need to match. That means you are more likely to get accurate information.</p>
<p class="bodycopy">When the credit bureaus pull reports for lenders, <span style="text-decoration: underline;">usually only 9 elements have to match</span>, for example only 2 letters in your last name. So, more errors and erroneous information will appear on your score &#8211; lowering it.</p>
<p class="bodycopy">Why do the Credit Bureaus provide different &#8211; and LOWER &#8211; scores to lenders? Because they&#8217;ve decided that by reporting lower &#8211; more conservative credit scores to lenders, they would be less likely to be sued by lenders if the borrower defaults on the loan.</p>

In the end, it comes down to how much can you do yourself based on your current  skills and experience, and how much would you benefit by hiring someone to handle the  more technical aspects of repairing your credit.</p>

<p>Having bad credit and low FICO credit scores is serious business, and fixing that problem should be done in a business-like manner. Picking up the phone and yelling at the lender&#8217;s customer support representative is not going to help repair your credit; in fact, it may make it worse.  Think about the person on the other end of the phone. Oftentimes they are simple, hard working people who take a lot of crap everyday on the phone. Not to mention they probably don&#8217;t get paid very much and work in a small cubicle in some windowless call center.</p>
<p>I discuss in other postings how to handle these type of folks when you make a phone call to them, however for now I want to discuss what to do when you send out a letter to a creditor.</p>
<p>When you write a letter to anyone other than the credit bureaus (more on them later), make sure that your words are simple, concise, and professional. </p>
<p>A simple credit repair letter can help you in a variety of ways:</p>
<p> <br />
1. Reduce your debt by negotiating repayment plans with your lenders, in writing. Especially in the current meltdown of banks, Wall Street, and the general market, this is probably the BEST time to be negotiating with your creditors. Debt negotiation letters can settle your debts, and erase bad credit, for a fraction of what you currently owe.  Your lenders will always want to recoup some of their losses, as opposed to having to write all of off your bad debt.  A simple letter can be very powerful in reducing the amount of money you owe, and perhaps avoid bankruptcy for you.</p>
<p>2. A well-crafted letter can also stop collection agencies and attorney debt collectors from harassing you.  It is your right to not be called in the middle of the night or while you are at work.  These companies sometimes &#8220;buy&#8221; your debt from the original lender, for a percent of the value.   Get these annoying parasites out of your life by putting it in writing.</p>
<p>3. Stop identity theft with a fraud alert letter.  If you suspect that an ID thief is using your personal identifying information to open a new credit account for their personal gain, place an &#8220;initial fraud alert&#8221; on all three of your credit reports (TransUnion, EquiFax, and Experian).  </p>
<p>This can only be done if you feel your personal information has been compromised.  The initial fraud alert letter requires that lending institutions call you at the phone number listed on your credit report to confirm any new transactions, effectively stopping any new ID theft, at least for the next 90 days.</p>
<p>4. Raise your credit score by removing inaccurate or negative information from your credit report.  Write to the credit bureau that is distributing the bad information, and spell out exactly why the data should be deleted from your report.  Perhaps you have paid off a loan that your report shows as outstanding.  Always include any copies of proof you may have, such as cancelled checks showing timely payments.  It never hurts to include the consequences that have resulted from the credit bureau including the inaccurate information as well.</p>
<p>Be sure to make a copy of all credit repair letters and any attachments for your own files.  It is all good evidence that you are working to establish a good line of communication with your creditors.</p>
<p>The impact of your credit repair letters will not be instantaneous.  But in a month or so you will likely find that your credit report will reflect the requested changes, that the identification theft has stopped, or that your lenders are negotiating in good faith with you in good faith to reduce your debt.  Keep in mind that you are repairing not only your credit, but also your good name and reputation.  </p>
